Terms of Service
Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you (the "User") and Paced ("we", "us"). By creating an account or using the Paced platform, you agree to be bound by these Terms.
Service description
Paced is a free bike-ride tracking web app for cyclists. The service includes:
- A free account, created with an email address and password.
- The ability to log rides, including distance, duration, elevation, route name, ride type, and notes.
- Personal statistics and records calculated from the rides you log.
- A web-based dashboard where you can view and manage your ride history.
Paced is currently provided free of charge. We reserve the right to add, modify, or remove features at any time. Material changes to core functionality will be communicated through the dashboard.
Account terms
You must provide accurate and complete information when creating your account and keep it up to date. You are responsible for maintaining the security of your account credentials. If you believe your account has been compromised, reset your password immediately from the login page and secure the email address linked to your account.
One person may maintain one account. Paced reserves the right to terminate accounts that violate these Terms.
Acceptable use
You agree to use Paced only for lawful purposes and in accordance with our Acceptable Use Policy. You must not access or attempt to access accounts or data that do not belong to you.
Pricing
Paced is free to use. There are no paid plans, and we do not collect or store any payment information. If we ever introduce paid features in the future, we will update these Terms and give you clear notice beforehand — you would never be charged without opting in first.
Data and privacy
Your use of Paced is subject to our Privacy Policy. By using the service, you agree to our collection and use of data as described therein.
Our Data Processing Addendum describes how we process your account and ride data and is incorporated into these Terms.
Paced collects the email address you use to create your account and the ride data you choose to log (such as distance, duration, elevation, route name, ride type, and notes). This data is stored under your account and is used to provide the service to you. We do not use it for advertising or sell it to third parties.
Service availability
We aim to maintain high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from service interruptions, outages, or downtime.
Current service status is available on our status page.
Disclaimer of warranties
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Paced disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Paced does not warrant that the service will be error-free, uninterrupted, or that any defects will be corrected. We do not make any representations or warranties regarding the completeness, accuracy, or reliability of any content, data, or statistics provided through the service.
Statistics accuracy
Paced calculates statistics and records based on the ride data you enter. These figures are provided for your personal interest and convenience.
You acknowledge and agree that:
- Statistics and records are derived from the data you provide and are only as accurate as that data.
- The service may occasionally display errors or inconsistencies.
- The accuracy of any calculation depends on the completeness and correctness of the data you log.
Paced does not guarantee any specific accuracy of statistics, and you should not rely on them for training, medical, or safety-critical decisions. You are solely responsible for your own cycling activity and any decisions you make based on the information shown.
Paced shall not be held liable for any loss, damage, or adverse outcome that results from reliance on the service's statistics or records. Your cycling activity is undertaken at your own risk.
Intellectual property
Paced and all associated software, designs, content, and trademarks are owned by Paced or its licensors. These Terms do not grant you any rights in the Paced intellectual property beyond the limited licence to use the service as described herein.
You retain all rights to the data you enter. You grant Paced a limited licence to process this data solely to provide the service to you.
Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with these Terms, and not to use such information except as necessary to perform obligations under these Terms.
Limitation of liability
To the maximum extent permitted by law, Paced's total cumulative liability to you for all claims arising out of or related to these Terms or the service shall not exceed the total fees (if any) paid by you to Paced in the three months preceding the claim.
Paced is not liable for: indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or business opportunity; or the actions or omissions of third-party services including Vercel or Google Firebase.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
Indemnification
You agree to indemnify and hold harmless Paced and its contributors from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party right.
Termination
Either party may terminate the agreement at any time. Paced may suspend or terminate your access immediately if you breach these Terms or engage in conduct that poses a risk to the platform or other users.
Upon termination: your access ceases, and we will delete your data in accordance with our retention policy. Provisions that by their nature should survive (intellectual property, liability, governing law) will do so.
Governing law
These Terms are governed by applicable law. We will attempt to resolve any disputes informally in the first instance.
Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via the dashboard at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree to the changes, you may stop using the service before the effective date.
