Terms of Service

Agreement

These Terms of Service ("Terms") are a legally binding agreement between you (the "User", "you") and Paced ("we", "us", "our"). By creating an account, accepting these Terms at sign-up, or using the Paced platform, you confirm that you are at least 18 years old and agree to be bound by these Terms, our Privacy Policy, our Acceptable Use Policy, and our Data Processing Addendum, each incorporated by reference. If you do not agree, do not use Paced.

The service

Paced is a cycling training web app. Depending on your plan, the service lets you:

  • Create an account with your email address and a password.
  • Log rides (distance, duration, elevation, route, type, cadence, power, heart rate, notes) and record training and fitness measurements.
  • View personal statistics, records, power curves, training zones, training load, and fitness/fatigue/form trends calculated from what you enter.
  • Follow a training plan, and receive personalised Paced AI and coaching insights.
  • Take part in optional communities, challenges, and badges.

We continuously develop Paced and may add, change, or remove features. We will communicate material changes to core functionality through the app.

Your account

You must provide accurate, complete information when you create your account and keep it up to date. You are responsible for keeping your credentials secure and for all activity under your account. If you believe your account has been compromised, reset your password immediately and secure your linked email. One person may hold one account. You must be at least 18 years old to use Paced.

Acceptable use

You agree to use Paced only for lawful purposes and in line with our Acceptable Use Policy. Among other things, you must not access data that is not yours, circumvent security or usage controls, or misuse community features. We may suspend or terminate accounts that breach these Terms or the AUP.

Plans, billing & subscriptions

Paced offers a free tier ("Rider") and optional paid subscriptions ("Pro" and "Max"). The free tier is genuinely free: no card is required and there is no time limit. You will never be charged unless you choose to start a paid subscription.

By starting a paid subscription you agree to the following:

  • Payment processor. Payments are handled by Stripe. You authorise us, via Stripe, to charge your chosen payment method. Your use of Stripe is also subject to Stripe's terms. We do not receive or store your full card details.
  • Recurring, auto-renewing billing. Paid plans are billed in advance on a recurring basis (monthly or annually, as you select) and renew automatically at the then-current price for the same interval until you cancel. Prices are shown at checkout in pounds sterling (£) and, where applicable, are inclusive of tax.
  • Free trials. Where a free trial is offered (for example, on Max for eligible first-time subscribers), your paid subscription begins automatically at the end of the trial and your payment method is charged the standard price unless you cancel before the trial ends. Trial eligibility is determined at checkout. Only one trial may be used per customer.
  • Cancellation. You can cancel at any time from the billing portal in your account. When you cancel, you keep paid access until the end of the period you have already paid for, and you are not charged again. After that, your account reverts to the free tier with your data intact.
  • Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods. Because Paced is digital content supplied immediately, by starting a paid subscription (or a trial that converts) you acknowledge that any statutory "cooling-off" cancellation right may be lost once the service has been provided. Nothing here affects your non-excludable statutory rights.
  • Price changes. We may change subscription prices. Any change to your recurring price will be notified in advance and will take effect from your next renewal; if you do not agree, you may cancel before it applies.
  • Referral rewards. Free months and other referral rewards have no cash value, are non-transferable, cannot be exchanged for money, and may be modified or withdrawn if the referral programme is abused. A reward applies only while you are not otherwise covered by a paid plan.
  • Downgrades and failed payments. If a payment fails or a subscription lapses, paid features may be suspended or removed, but your logged rides and history remain accessible on the free tier.

Your content and communities

You retain all rights to the data and content you enter into Paced ("Your Content"). You grant us a limited, worldwide, royalty-free licence to host, store, process, and display Your Content solely to operate and provide the service to you — including calculating your stats and generating your insights, and, where you choose to join a community, displaying the content you elect to share to other members of that community.

You are responsible for Your Content and confirm you have the right to submit it. You must not post or share content that is unlawful, infringing, harassing, hateful, or otherwise in breach of our Acceptable Use Policy. We may remove content or restrict community access that breaches these Terms.

Health, fitness & safety disclaimer

Paced is a training and tracking tool, not a medical device and not a provider of medical, health, or professional coaching advice. Training metrics, zones, load, fitness estimates, plans, and Paced AI or coaching insights are provided for general informational purposes only and are calculated from the data you enter.

Cycling and physical training carry inherent risks. You are solely responsible for your own health and activity. Always ride within your limits, obey the law and road rules, and consult a qualified medical professional before starting, changing, or intensifying any training programme, particularly if you have any health condition. Do not rely on Paced for medical, safety-critical, or emergency decisions. You undertake all cycling activity at your own risk.

Paced AI & insights

Paced AI and the app's coaching insights generate personalised observations, focus suggestions, and breakdowns from your own training data. They are informational aids, provided "as is", may be incomplete or occasionally inaccurate, and are not guarantees of any result, performance, or outcome. You should apply your own judgement and, where appropriate, professional advice. We may change, add, or remove these features over time.

Service availability

We aim for high availability but do not guarantee uninterrupted or error-free service. Planned maintenance will be communicated in advance where possible. To the extent permitted by law, we are not liable for losses arising from interruptions, outages, or downtime.

Disclaimer of warranties

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Paced disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or uninterrupted, or that any defects will be corrected, and we make no representations about the completeness, accuracy, or reliability of any content, data, statistics, or insights provided through the service.

Accuracy of statistics and estimates

Paced calculates statistics, records, estimates, and insights from the data you enter. You acknowledge that:

  • They are only as accurate as the data you provide and the assumptions of the underlying models.
  • The service may occasionally display errors, estimates, or inconsistencies.
  • You should not rely on them for medical, safety-critical, or financial decisions.

You are solely responsible for your cycling activity and any decisions you make based on the information shown.

Intellectual property

Paced and all associated software, designs, branding, content, and trademarks are owned by Paced or its licensors. These Terms grant you only a limited, personal, non-transferable, revocable licence to use the service as intended. You gain no other rights in Paced's intellectual property. You retain all rights in Your Content as set out above.

Limitation of liability

To the maximum extent permitted by law, Paced's total cumulative liability to you for all claims arising out of or related to these Terms or the service shall not exceed the greater of (a) the total fees you paid to Paced in the three months before the claim, or (b) £50.

Paced is not liable for: indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, goodwill, or business opportunity; personal injury or health outcomes arising from your training or reliance on the service; or the acts or omissions of third-party services including Stripe, Google Firebase, and Vercel.

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under applicable law. Nothing in these Terms affects your non-excludable statutory rights as a consumer.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Paced and its contributors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the service, your breach of these Terms, or your violation of any law or third-party right.

Termination

You may stop using Paced and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or the AUP, or if your conduct poses a risk to the platform or other users. On termination, your access ceases and we delete your data in line with our Privacy Policy retention periods. Any accrued payment obligations, and provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law), survive termination.

Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except that if you are a consumer resident elsewhere you may benefit from any mandatory protections of, and the right to bring proceedings in, your country of residence. We will try to resolve any dispute informally first — please contact us through our contact form before taking formal action.

Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes via the app and update the "Last updated" date. Changes take effect on the stated effective date; continued use after that date constitutes acceptance. If you do not agree, you may stop using the service and cancel any subscription before the changes take effect.
